The Ministry of Housing and Urban Affairs (MoHUA) has issued an advisory directing all State Real Estate Regulatory Authorities (RERAs) to grant a four-month extension to eligible real estate projects impacted by recent global supply chain disruptions linked to the ongoing West Asia situation.
The advisory, issued on July 31, 2026, recognizes the disruption as a Force Majeure event that has significantly affected the availability of essential construction materials, resulting in project delays across the real estate sector.
The Ministry referred to the Finance Ministry’s memorandum dated April 29, 2026, which classified the West Asia situation as a “war” for the purpose of invoking the Force Majeure clause. Under Section 6 of the Real Estate (Regulation and Development) Act, 2016 (RERA), project registrations may be extended when delays arise due to circumstances beyond the control of developers.
According to the advisory, the extension will apply to projects whose original, revised, or previously extended completion dates fall on or after February 28, 2026. Eligible projects will receive a four-month extension to their registration and completion timelines.
To simplify implementation and reduce administrative burden, the Ministry has also recommended that State RERAs issue a single common order covering all eligible projects instead of requiring developers to submit individual extension applications for each project.
